Terms of Service

1. Acceptance

By accessing or using FindWell ("Service") you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Service description

FindWell monitors public procurement portals and delivers scored tender summaries by email according to monitoring rules you configure. The Service is a discovery and notification tool. It does not prepare, submit, or manage bids on your behalf.

3. Accuracy and reliability

Tender data is sourced from official portals via REST APIs. While we endeavour to keep data current and accurate, we make no warranty that all notices are captured or that match scores reflect the full content of a tender document. Always verify tenders against official sources before investing resources in a bid.

4. Subscription and payment

The Service is billed monthly at €249. Payment is processed by Stripe. There is no annual contract and no notice period; the subscription renews monthly. You may cancel at any time from your account settings, and access continues until the end of the paid month. No refunds are issued for partial months.

5. Acceptable use

You may use the Service only for lawful business purposes. You may not resell, redistribute, or sublicense access to the Service. Automated scraping of the dashboard or API beyond normal use is prohibited. You must not enter special categories of personal data (as defined in Article 9 GDPR — for example data revealing health, racial or ethnic origin, religious beliefs, or trade-union membership) into any free-text field, including company descriptions, keywords, task notes, and comments. The Service is not designed to process such data, and you are responsible for ensuring it is not submitted.

6. Intellectual property

Tender notices published on official portals are public-domain government data. Our scoring algorithms, application code, and insight content are proprietary to FindWell and may not be copied or reproduced without written permission.

7. Limitation of liability

To the maximum extent permitted by applicable law, FindWell is not liable for any indirect, incidental, or consequential damages arising from missed tenders, incorrect scores, or service downtime. Our aggregate liability is limited to the fees paid in the three months preceding the claim.

8. Governing law

These Terms are governed by Dutch law. Any disputes shall be submitted to the exclusive jurisdiction of the courts of Amsterdam, the Netherlands.

9. Changes

We may update these Terms. Material changes are notified by email 14 days in advance. Continued use after the effective date constitutes acceptance.
